Section 1.04.010 Definitions.

    The following words or phrases whenever used in the ordinances of the City of Vernal shall be construed as defined in this section unless from the context a different meaning is intended or unless a different meaning is specifically defined or more particularly directed to the use of such words or phrases:
    "City" or "Town" each mean the City of Vernal, Utah, or area within the territorial limits of the City of Vernal, Utah, and such territorial limits of the City of Vernal, Utah, over which the City of Vernal, Utah, has jurisdiction or control by virtue of any constitutional or statutory provision.
    "City Council" means the City Council of the City of Vernal. "All it's members" or all "Council Members" means the total number of Council Members holding office, but does not include the Mayor.
    "County" means the County of Uintah.
    "Governing Body" means a Council composed of six members, five of whom are City Council Members and one of whom shall be the Mayor.
    "Knowingly" imports only a knowledge that the facts exist which bring the act or omission within the provision of these ordinances. It does not require any knowledge of the unlawfulness of such act or omission.
    "Law" denotes applicable federal law, the Constitution and statutes of the state of Utah, the ordinances of the City of Vernal, and when appropriate, any and all rules and regulations which may be promulgated thereunder.
    "May" is permissive.
    "Month" means a calendar month.
    "Must" and "shall" are each mandatory.
    "Neglect," "negligence," "negligent" and "negligently" import a want of such attention to the nature or probably consequences of the act or omission as a prudent man ordinarily bestows and acting in his own concern.
    "Oath" includes an affirmation or declaration in all cases in which, by law, an affirmation may be substituted for an oath and in such cases the words "swear" and "sworn" shall be equivalent to the words "affirm" and "affirmed."
    "Ordinances" or "these ordinances" means the ordinances that are codified in this volume or as otherwise adopted by the City.
    "Owner" applied to a building or land, includes any part owner, joint owner, tenant in common, joint tenant, tenant by the entirety of the whole or a part of such building or land.
    "Person" includes a natural person, joint venture, joint stock company, general or limited partnership, association, club, company, corporation, trust, organization, business or any business entity or the manager, lessee, agent, servant, officer or employee of any of them.
    "Personal property" includes every description of money, goods, chattels, effects, evidences of rights in action and all written instruments by which any pecuniary obligation, rights or title to property is created, acknowledged, transferred, increased, defeated, discharged or diminished and every right or interest therein.
    "Preceding" and "following" mean next before and next after, respectively.
    "Property" includes real and personal property.
    "Real property," "land" and "real estate" include lands, tenements, hereditaments, water rights, possessory rights and claims.
    "Sidewalk" means that portion of the street between the curb line and the adjacent property line intended for the use of pedestrians.
    "Signature" includes any name, mark or sign written with the intent to authenticate any instrument or writing.
    "State" means the state of Utah.
    "Street" includes all streets, highways, avenues, lanes, alleys, courts, places, squares, curbs or other public ways in this City which have been or may hereafter be dedicated and open to public use or such other public property so designated in any law of this state.
    "Tenant" and "occupant" applied to a building or land, include any person who occupies the whole or part of such building or land whether alone or with others.
    "Wilfully" when applied to the intent with which an act is done or omitted, implies simply a purpose or willingness to commit the act or make the omission referred to. It does not require any intent to violate law or to injure another or to acquire any advantage.
    "Written" includes printed, typewritten, mimeographed, multigraphed, or otherwise reproduced in permanent form.
    "Year" means a calendar year. (Added during 1993 recodification)
