Section 12.04.070 Alternative uses of public streets, sidewalks and public places--Permit-- Recommendation on application--Issuance/Denial.

    The Chief of Police, upon receipt of an application and any necessary fees agreement, shall within five (5) days submit the application to the Mayor  or his designee  with a recommendation as to whether or not the anticipated use should be permitted and an estimate as to the amount of potential cleanup expense or the amount necessary to repair potential damage to public property. The Mayor shall thereafter either grant or deny the permit, or grant the permit conditioned upon the applicant furnishing the City a bond in an amount reasonably calculated to offset potential cleanup expense or to repair potential damage to public property resulting from the anticipated use. Such permit, however, shall grant the use requested for a temporary period of not more than ninety (90) days. A signed copy of the approved permit shall be delivered to the applicant , or in the event of refusal of the permit  a written notification shall be sent to the applicant . In the event of refusal by the Mayor  or his designee , reasons therefor shall be plainly set forth in the notification . (Added during 1993 recodification)
