Chapter 13.28 REGULATION OF SEWER USE
Section 13.28.220 Violation--Penalty.
A. Any person found to be violating
any provisions of this chapter except Section 13.28.190
shall be served by Vernal City with written notice stating the nature of the violation and
providing a reasonable time limit for satisfactory correction thereof. The offender shall, within
the period of time stated in such notice, permanently cease all violations.
B. Any person who continues any violation
beyond the time limit provided for in subsection
A of this section shall be guilty of a misdemeanor, and on conviction thereof shall be fined in the
amount not exceeding two hundred ninety-nine (299) dollars for each violation. Each day in
which any such violation continues shall be deemed a separate offense.
C. Any person violating any of the
provisions of this chapter shall become liable to Vernal
City for any expense, loss or damage occasioned Vernal City by reason of such violation.
D. The owners of all houses, buildings
or properties, as defined in Section 13.28.050 (Use of
public sewers required), who are not in compliance with the provisions of Sections 13.28.020
through 13.28.050 shall, after being served by notice of noncompliance within the time frame as
provided in Section 13.28.050, be required to pay monthly sewer service fees as established by
resolution of the Vernal City Council. (Ord. 86-10 § 1; Ord. 79.10, Art. IX)
