Section 16.10.010 Appointment--Term--Removal.
Prior to the adoption of Ord. 2007-04 on 05/16/2007, Section 16.10.010 read as follows.
The Board of Adjustment shall consist of five (5) members and three (3) alternates,
each to be appointed by the Mayor with the consent of the City Council for a term of five
(5) years. Only one member of the City Council or only one Planning
Commissionmember shall be a member of the Board of Adjustment.
No member of the
Board of Adjustment / Appeal Authority shall also serve as a member of the City Council
or the Planning Commission / Land Use Authority.
Any member or alternate member
may be removed for cause by the City Council upon written charges and after a public
hearing, if such public hearing is requested. Vacancies shall be filled for the unexpired
term of any member or alternate member whose term becomes vacant by the Mayor with
consent of the City Council. Alternate members shall have no voting privileges except
when a member be temporarily unable to act owing to the absence from the City, illness,
interest in a case before the Board or any other cause, and when the alternate member is
needed to create a full quorum of five (5) members, providing that at no time may more
than two (2) alternate members sit at any one meeting of the Board of Adjustment at one
