Chapter 16.10 BOARD OF ADJUSTMENT
Section 16.10.100 Variance procedure--Time limitation.
A. Applications for variance shall be filed with the
secretary of the Board of
Adjustment. The application shall contain the following:
1. A description of the requested variance, together
with a designation of that
ordinance from which relief is being requested;
2. An accurate plot plan, if appropriate, indicating
the manner in which the variance
will be applied and its effect upon adjacent properties;
3. A list of property owners, together with current mailing
addresses, of property
owners within five hundred (500) feet of any property subject to the requested variance,
as listed upon the latest assessment roll prepared by the Uintah County Assessor;
4. The filing fee.
B. Upon receipt of the application by the secretary of
the Board of Adjustment, a
copy shall be submitted to the office of the City Recorder for filing, and a copy with all
accompanying materials shall be forwarded to the Board of Adjustment for their action
upon request. The Board shall hold a public hearing on the variance. At least fourteen
(14) day's notice of the time and place of such hearing shall be published in a newspaper
of general circulation in the City. Also, written notices shall be mailed to owner's of
property within five hundred (500) feet of the proposed variance location. The notices
shall state the time and place of the hearing of the variance.
C. Decisions of the Board become effective at the meeting
in which the decision is
made, unless a different time is designated at the time the decision is made. In the event
the Board does grant a variance in accordance with the provisions of this chapter,
alterations in accordance with the variance must be commenced within six (6) months or
if the petitioner shows adequate cause to the Board that circumstances warrant, a time
extension may be granted. (PZSC § 03-04-010)
