Section 5.20.340 Licenses prohibited near churches and schools.

    No license under the provisions of this Chapter, shall be granted to sell beer or liquor for consumption on the premises of any proposed or existing business which is in the proximity of any school or church where the primary or main business is that of selling beer or liquor for consumption on the licensed premises.  Such premises shall include, but shall not be limited to, taverns, bars, beer parlors, lounges, cabarets, and night clubs where the revenue for the sale of beer and / or liquor would exceed the revenue for the sale of food items.   For the purpose of this Chapter, the Licensing Clerk may, in his discretion, distinguish between classes of licenses in determining proximity both to location and as to influence upon the public health, safety, welfare, peace, or morals.   This provision shall not apply to any premises licensed under the provisions of this Chapter on or before December 19, 1996.   (Prior code § 11-05-034)(Ord.
