Section 5.20.440 Nuisance--Defined.

    For the purpose of this chapter, a nuisance is created on any premises when:
    A.    Alcoholic beverages are manufactured, sold, kept, bartered, stored, or given away or used, or where persons resort to drinking alcoholic beverages, contrary to the Alcoholic Beverage Control Act of the state or this chapter; or where
    B.    1.  Intoxicated persons are permitted to loiter about, or
    2.    Profanity, indecent, immoral, loud or boisterous language or immoral or lewd conduct is permitted or carried on; or where
    C.    Beer is sold, dispensed or consumed on any premises required to be licensed under the provisions of this chapter between the hours of 1:00 a.m. and 10:00 a.m. of any day. These provisions shall not apply to premises licensed as class A establishments; or where
    D.    Liquor is sold or allowed to be sold, or consumed or allowed to be consumed, on any premises required to be licensed under the provisions of this chapter, between the hours of 12:00 midnight and 12:00 noon, or on a state or national election day, before the polls are closed; or where
    E.    Persons under the age of twenty-one (21) are permitted to purchase or consume alcoholic beverages; or where
    F.    Laws or ordinances which tend to effect the public health, peace or morals are violated by the licensee or patrons upon such premises with the consent or knowledge of the licensee. (Prior code § 11-05-044)
