Section 5.20.450 Sale to person under age prohibited.

     A.     It is unlawful for any licensee or operator or employee of any licensee to sell any alcoholic beverage to any person under twenty-one (21) years of age.
     B.   It is unlawful for any person under the age of twenty-one (21) years of age to consume alcoholic beverages on the premises. (Prior code § 11-05-045)
     C.    Any licensee violating the provisions of Section 5.20.450(A) may, in lieu of revocation or suspension of the licensee's Vernal City business licence, or other criminal penalties, consent to administrative penalties described as follows.
        1.    1st violation:
            a.    Letter of reprimand sent to licensee for violation of Vernal City ordinance and Utah State law.
            b.    Licensee to provide to the City a report evidencing that all clerks / cashiers selling any alcoholic beverage by name and date have completed all Utah State required certification training, allowing the sale of alcoholic beverages and that all clerks / cashiers are currently certified to sell alcoholic beverages, such report being delivered to Vernal City within ten (10) days of request.
        2.    2nd violation within one (1) year period of previous violation:
            a.    Same as C(1).
            b.    Mandatory $250.00 civil fine payable to Vernal City within the time frame as required by the City.
            c.    Mandatory one (1) week suspension of licensee's alcoholic beverage license for the specific period as required by the City.
        3.    3rd violation within one (1) year period of previous violation:
            a.    Same as C(1).
            b.    Mandatory $500.00 civil fine payable to Vernal City within the time frame as required by the City.
            c.    Mandatory two (2) week suspension of licensee's alcoholic beverage license for the specific period as required by the City.
        4.    4th violation within one (1) year period of previous violation:
            a.    $1,000.00 civil fine payable to Vernal City within the time frame as required by the City.
            b.    Suspension of licensee's alcoholic beverage license for one (1) year.
