Prior to the adoption of Ord. 2012-03 on 01/18/2012, Section 5.36.140 read as follows.

No person shall be relieved from the provisions of this title by reasons of a temporary association with any local dealer, trader, or merchant or auctioneer, or by conducting such temporary or transient business in connection with, as a part of, or in the name of any local dealer, trader, merchant or auctioneer. (Ord. No. 95-23, Enacted, 10/18/95) Neither the City nor Rocky Mountain Power shall be excused from complying with any of the terms and conditions of this Franchise by any failure of the other, or any of its officers, employees, or agents, upon any one or more occasions to insist upon or to seek compliance with any such terms and conditions.
