Chapter 6.20 IMPOUNDMENT - SHELTERING
Section 6.20.010 Power and authority.
A. Animal control officers:
Animal Control Officers or any Law Enforcement Officer may apprehend, take with
them, and impound any animal in violation of this title. Animal Control Officers or any
Law Enforcement Officer may enter upon open premises, including any pen or enclosure
designed to house animals, and may apprehend, take with them and impound any animal
which the officer has observed running at large immediately prior to the officer's entry
upon the premises, or where such entry is otherwise authorized by law, or where the
officer observes that the animal or conditions under which the animal is kept or
maintained constitutes a nuisance as defined in Sections 6.12.010, 6.12.020, and
6.12.090. Entry may be made into a residence only when authorized by law, excepting
when immediate entry is necessary in order to protect persons or property from immediate
and substantial harm or damage. Entry upon any premises may also be obtained by
warrant in accordance with applicable law.
B. Animal shelter manager:
The animal shelter manager shall have the power and
authority to impound animals
or to take for sheltering animals brought to the shelter. The shelter manager shall have
the power and authority to conduct reclaims, fosters, and adoptions from the shelter and
to process owner releases. Once animals are impounded or sheltered, unless court action
is filed, the animal becomes municipal property and will be disposed of as determined by
the shelter manager and in accordance with the ordinances of the City. (CC § 08-10-004
