Section 8.08.040 Appeals.
Prior to the adoption of Ord. 2007-15 on 06/06/2007, Section 8.08.040 read as follows.
The City Council shall serve as a Board of Appeals to consider any application
of any
person aggrieved by a decision of the Building Inspector or
the Zoning Enforcement
Officer
his agent. Such appeal must be filed in the office of the City Manager within
ten
(10) days after the receipt of notice from the Building Inspector or
the Zoning
Enforcement Officer
his authorized agent together with a filing fee of ten (10) dollars.
The decision of the City Council shall be final. If the decision of the Council is against
the owner, the City Council shall require the owner to eradicate, or destroy and remove
the noxious weeds, garbage, refuse, or unsightly or deleterious objects or structures
within such time as the Council shall designate, which shall not be less than ten (10) days.
Notice of the decision of the City Council and the notice to comply with the decision
shall be sent to the owner as provided in Section 8.08.020. (Ord. 83-22 § 4)
