Chapter 9.16 NOISE CONTROL
Section 9.16.040 Exemptions.
The following shall be exempt from this ordinance so long as the noise made thereby
is reasonable and necessary.
A. Sounds created by emergency
work
or
authorized
emergency vehicles; sounds
giving warning of emergency shall be exempt from the provisions of this chapter.
B.
Noise resulting from lawful fireworks and noise-makers used for celebration of an
official holiday.
C. Any noise resulting from activities of temporary duration permitted by law
for
which a license or permit has been approved in accordance with Section 9.16.040 of this
Chapter.
D. The reasonable sounding of bells, chimes, whistles,
musical devices by houses of
worship, schools, ice cream trucks, seasonal contribution solicitors, or by law
enforcement for traffic control purposes.
E.
Sounds created by parades, carnivals,
music,
public events or construction
projects may be exempted from the noise provisions of this chapter. An exemption is
granted by a permit from the Mayor or his designee, which must be in writing and shall
describe:
1. The special nature of the
exempted event;
2. The time period for which
the exemption is in force;
3. Other information as required
by the permit.
The permit shall be for one (1) event only.
Sound levels emanating from an outdoor
concert or outdoor musical event shall not exceed 65 DBA measured from the nearest
residential use or 500 feet, whichever is farthest from the closest outside perimeter line of
the event.
The Mayor or his designee may impose reasonable conditions on the issuance
of a permit as necessary to protect the public peace and welfare
, notwithstanding,
however, that exemptions shall not be granted for any time period beyond 12:00 midnight
or any sooner than 5:30 a.m
. The permit may be withdrawn if the provisions thereof are
violated.
F.
Violation of the noise provision of this chapter, or of the conditions of an
exemption permit shall be a class B misdemeanor. (Ord. 91-17 § 4)
