Section 9.32.050 Reasonable regulation.

    A.    Whereas, Vernal City has a duty to preserve the health, safety and welfare of the residents; and
    B.    Whereas, the Vernal City Council finds and determines that synthetic marijuana described hereunder is intoxicating and/or hallucinogenic to humans upon ingestion and is often used as an alternative to marijuana; that this chemical is potentially dangerous to users; and that its long term health effects are unknown; thus, the use of this intoxicating chemical creates a significant health and safety risk to the citizens of Vernal City; and
    C.    Whereas, certain businesses within the Vernal City limits are currently selling synthetic marijuana described hereunder as incense or aromatics, but which is typically used for human ingestion; such substance is gaining in popularity at an alarming rate among high school and college aged individuals, as well as among parolees and probationers;
    D.    Whereas, synthetic marijuana described hereunder is not yet categorized as a controlled substance under State or Federal law; and
    E.    Whereas, in the interest of the health, safety and welfare of its citizens, Vernal City deems it appropriate and necessary to prohibit the possession of synthetic marijuana described hereunder.
